Mettant fin à une longue attente, transformant les salons, trains, bureaux, et autres lieux où les candidats de la session 2016 ont découvert leurs notes en zone "kiss and cry" comme on dit dans la langue de Candeloro, cette liste met un point final aux incertitudes qui pouvaient nous ronger depuis certains jours de début mars.<br />

Félicitations à tous ceux qui ont validé un ou plusieurs modules, courage pour les moins fortunés qui devront user leurs stabylos et autres stylos une nouvelle fois, en particulier à ceux qui expérimenteront la nouvelle mouture des épreuves A et B.<br />

La liste actuelle ne fait pas le distinguo entre les épreuves Chimie et Physique, mais j'attends avec une certaine impatience les statistiques de cette année, les épreuves A et B chimie ayant constitué une sorte de "bouquet final" si l'on en croit le ressenti présenté dans l'<a href="http://documents.epo.org/projects/babylon/eponot.nsf/0/F44C9420110CB76EC1257FD3004961FB/$File/Survey_2016_final.pdf" target="_blank">étude réalisée après l'EEQ</a> (cf p.215 et 216).<br />

Les taxes sont le nerf de la guerre, et il y a de multiples moyens de payer celles-ci. <a href="https://goo.gl/RgB4H6">Cette fiche</a> ne reprend que quelques éléments des RRT, RCC et autres RPA et ne prétend donc absolument pas à l'exhaustivité. Elle se veut surtout un moyen d'accéder un peu plus rapidement à ces textes dont la lecture n'est pas des plus exaltante...<br />

Il n'y a pas de procédure de recours proprement dite dans le cadre du PCT. Si l'Office récepteur se trompe, ou considère la demande comme retirée, ainsi que dans quelques autres cas, il existe un mécanisme de révision par les Offices Désignés (DO).<br />
<br />
Ce mécanisme est décrit avec la limpidité habituelle dans le Traité de Coopération et son règlement d'exécution.<br />

Les circonstances de la saisine sont rappelées dans <a href="http://ipkitten.blogspot.fr/search/label/house%20ban" target="_blank">une série d'articles</a> publiés sur le blog, circonstances qui agitent l'OEB depuis de longs mois. En substance, le requérant (le Conseil d'Administration) cherche à obtenir une proposition de la Grande Chambre visant à relever de ses fonctions un membre d'une chambre de recours.<br />

Il ne s'agit ici ni d'analyser ni de commenter le cas d'espèce, par ailleurs déjà suffisamment sensible et litigieux (il suffit de jeter un œil sur les commentaires des articles d'IPKat pour s'en rendre compte). Cependant, un point de la décision mérite d'être relevé hors du contexte de cette affaire. Il s'agit de la "substantiation" des faits. Car en la matière, il semble que la requérante ait agit un peu légèrement.<br />

La décision n'ayant pas encore été publiée sur le site de l'OEB, aucune citation in extenso ne sera réalisée ci-après. Je vous renvoie à la version mise à disposition sur IPKat. Par ailleurs, et sans doute pour des raisons de confidentialité, la décision est assez largement caviardée, ce qui n'améliore pas sa lecture.<br />

Dans les motifs (point 7 et suivants), la GCR rappelle que la requête "doit

Le Comité d'Administration ne se réfère qu'au rapport de la Commission Disciplinaire, le déclarant partie intégrante de la requête, le support des allégations étant contenu dans une clé USB remise à la GCR. Ladite clé semble contenir un volume très important de documents.<br />

Or les faits et preuves doivent être clairement exposés, afin que l'intimé puisse y répondre en pleine connaissance de cause. Il n'est pas du ressort de la Grande Chambre de faire le lien entre les faits allégués, et les documents présentés.<br />

difficultés ont été identifiées. Elles font actuellement l'objet de
mesures correctrices destinées à les supprimer et qui clarifieront à
brève échéance l'articulation des normes juridiques régissant les
demandes concernées. Dans l'immédiat, après une analyse conjointe avec
les services juridiques de l'État, il importe de souligner qu'en dépit
de ces zones d'ombre, les dispositions de l'article L. 612-1 du code de
la propriété intellectuelle (CPI) permettent toujours de garantir la
parfaite sécurité juridique des demandes déposées auprès de l'INPI à
compter du 12 novembre 2014.</div>

De retour après un petit séjour à l'étranger, voici aujourd'hui une décision rendue il y a déjà quelques mois, mais qui illustre le pouvoir dont la Chambre de recours dispose, en particulier dans les procédures ex-parte.</div>

Il s'agit d'un recours contre la décision de la division d'examen de rejeter la demande de brevet pour manque d'activité inventive. Dans son mémoire, la demanderesse a soumis un nouveau jeu de revendications, argumenté en faveur de l'activité inventive, et requis la tenue d'une procédure orale.</div>

La Chambre a fixé une date pour la procédure orale. Dans sa communication selon l'art.15(1) RPCR, la Chambre a indiqué qu'elle n'était pas convaincue par les arguments de la demanderesse, et soulevait une infraction à l'art.123(2) CBE.</div>

by a decision based on grounds which might be enforced against such
claims in its absence</span> (T 0991/07, Reasons, 2; T 1704/06, Reasons, 7; T
0546/08, Reasons, 2). In these decisions, it is emphasized that the
purpose of oral proceedings is to give a party the opportunity to
present its case. However, the party gives up this opportunity if it
does not attend the oral proceedings (T 0546/08, Reasons, 2.2). </blockquote>

2.1.6 In view of the foregoing, the following conclusions are drawn.</blockquote>

ex parte appeal proceedings a board has the power to enforce any
grounds for refusal of an application, in particular grounds which the
examining division did not consider at all or held to be satisfied (G
0010/93). Said grounds will be communicated to the appellant in writing,
for example with a communication under Article 15(1) RPBA, <span style="background-color: #f6b26b;">and/or
orally</span> during scheduled oral proceedings.</blockquote>

The board's
communication, however, <span style="background-color: #f6b26b;">has a preliminary character and does not have to
be exhaustive</span>. Thus, should the board, when reconsidering a case
shortly before the oral proceedings in preparation thereof, identify new
grounds for refusal of the application that were not mentioned in its
previous communication, said new grounds will have to be discussed
during the oral proceedings, the aim of which is not a simple repetition
of what was already submitted in writing.</blockquote>

In ex parte appeal
proceedings, if a duly summoned appellant does not attend the scheduled
oral proceedings, the board, in view of the principle of procedural
economy, shall not be obliged to delay its decision by reason only of
the appellant's absence at the oral proceedings (Article 15(3) RPBA).
<span style="background-color: #f6b26b;">Due to its absence, the appellant waives the opportunity to present its
comments on new grounds</span> which were not mentioned in the communication
under Article 15(1) RPBA but are decisive for the decision. In such a
case, the board's decision dealing with said new grounds, on which the
appellant has not presented its comments, does not contravene the
principle of the right to be heard (Article 113(1) EPC 1973).</blockquote>
Maintenant, la Chambre décide d'achever la demande à coup de 123(2), comme si elle n'assumait pas totalement le "mauvais coup" qu'elle venait de jouer à la demanderesse.<br />

3. Article 123(2) EPC</blockquote>

The Board is aware of the fact that the above finding that claim 1
according to the appellant's request does not meet the requirements of
Article 84 EPC 1973 is sufficient for concluding that the request is not
allowable. As already stated above, the present decision does not
contravene the principle of the right to be heard despite the
introduction of Article 84 EPC 1973 only at the oral proceedings.</blockquote>
<blockquote class="tr_bq">
Nevertheless,
<span style="background-color: #f6b26b;">for the sake of argument</span> the Board holds it appropriate to deal with
the further ground according to Article 123(2) EPC, especially in view
of the conclusion drawn below in this respect. <span style="background-color: #f6b26b;">These additional remarks
are made in view of the peculiarity of the present case that the Board's
communication pursuant to Article 15(1) RPBA mentioned inter alia
Article 123(2) EPC but not Article 84 EPC 1973</span>. In the following

Nouvelle génération, car il ne suffisait plus d'avoir 50/100 cette année. L'OEB, voulant couper court au fléau de la réussite de masse, a en effet décidé de relever la barre à 70/100. On peut se demander s'il était nécessaire de se précipiter pour modifier les conditions de réussites au pré-EEQ, vu que l'on a encore très peu de recul sur les performances des candidats estampillés "pré-EEQ" à l'examen principal, mais bon.<br />

Alors, quel est le bilan ?<br />

Sur 662 candidats, 555 ont passé la barre, soit un taux de réussite de <b style="background-color: #f4cccc; color: black;">83,8%</b>, moins que l'an dernier (99,69%). 14 candidats ont écopés d'un zéro (très probablement des candidats ne s'étant pas présentés), la note la plus basse se situant plutôt aux alentours de 35. La note la plus élevée est de 98. En voilà un qui se mordra les doigts d'avoir loupé le carton plein, mais il n'avait qu'à bosser... <br />
<br />
La majeure partie des gens se situent entre 80 et 90, 19,4% des candidats obtenant au moins 90/100. La note médiane est de 82,5.<br />
<br />
Et maintenant, la question est : l'OEB va-t-il relever la barre à 75/100 l'an prochain pour atteindre un taux de 75% de réussite au pré-EQE ?<br />

Bien que le fond de l'affaire soit totalement différent, l'exposé de la nécessité d'adresser cette question à la Grande Chambre de Recours est sensiblement le même que dans la décision <a href="http://www.epo.org/law-practice/case-law-appeals/recent/t131553dx1.html#q=">T 1553/13</a>. Cette décision a toutefois l'intérêt de permettre au public non germanophone et ne pouvant attendre la publication au JO d'accéder au raisonnement, en anglais cette fois. Pour faire bonne mesure, il serait opportun qu'une chambre de recours adresse la même question dans une procédure dont la langue est le français...<br />
<br />
Un point de cette décision <a href="http://www.epo.org/law-practice/case-law-appeals/recent/t122017ex1.html">T 2017/12</a> est tout de même assez amusant. Ce recours fait suite à la décision de la division d'examen de rejet de la demande de brevet. La décision a été signifiée le 15 novembre 2011 et le recours formé le 31 mai 2012.<br />

Pas besoin de consulter le calendrier des jours de fermeture de l'OEB pour se rendre compte que le délai de 2 mois pour former recours, et de 4 mois pour soumettre le mémoire étaient dépassés.<br />
<br />
Le déposant a fait une requête en <i>restitutio in integrum</i>, soutenant que l'entreprise était en train de changer de mains, et que les négociations, plus complexes que prévues, avaient provoqué l'erreur ayant conduit à ne pas respecter le délai pour former recours. Cet argument n'a pas été retenu par la Chambre:<br />

1.3.2 Due care in take-over periods</blockquote>
<blockquote class="tr_bq">
As a starting point <span style="background-color: #f4cccc;">the board accepts that in the course of complicated transfers of ownership of a company isolated mistakes cannot be entirely avoided despite all due care</span>. But this does not mean that transfer negotiations alone are an
acceptable excuse for failing to observe time limits. Consequently, t<span style="background-color: #f4cccc;">he
board cannot accept the appellant's argument that company transfer
negotiations per se constitute exceptional circumstances</span> which would
establish that all due care had been taken although a time limit was
missed. The board considers that the take-over of a company <span style="background-color: #f4cccc;">is a normal
economic activity which does not necessarily affect everyday business</span>.
The board concludes that it was up to the appellant to provide details
as to why the present take-over negotiations may have affected the
patent administration in an exceptional manner.</blockquote>
D'autant plus que le déposant n'a apparemment pas été très explicite quant à la justification de l'influence des négociations sur le loupé des délais:<br />

1.3.3 The facts of the case at hand</blockquote>
<blockquote class="tr_bq">
[...]The appellant <span style="background-color: #f4cccc;">did not provide any detail</span> regarding the
patent handling procedures employed by the applicant or the new owner <span style="background-color: #f4cccc;">
and how they might have been affected by the "turbulent" takeover
negotiations</span>; reference is only made to "a long history of patent
development" and "a hitherto flawless record". Also <span style="background-color: #f4cccc;">no concrete details</span>
were given of the nature of the error and how it occurred; all that is
said is that "SnapNames or Oversee ... apparently forgot to instruct the
professional representative".</blockquote>
Deux délais ayant été manqués (les 2 mois de la formation du recours et les 4 mois pour soumettre le mémoire), le déposant a payé deux taxes de <i>Restitutio</i>. Il demande le remboursement de l'une de ces taxes, en se basant sur le principe de bonne foi et sur le fait que la décision de l'OEB d'accorder la <i>Restitutio</i> pour ces deux évènements ne nécessitait pas plus de travail que de décider d'accorder la <i>Restitutio</i> pour un seul de ces évènements...<br />
<blockquote class="tr_bq">
IX. In its letter of 23 September 2013 the appellant, despite having
been informed via both the minutes and the subsequent communication that
the board had decided this point, further argued that <span style="background-color: #f4cccc;">the fees for the
omissions of filing the appeal and the grounds were in fact only one
issue</span>, as they were closely interlinked. Following the principle of good
faith only one fee should be paid, <span style="background-color: #f4cccc;">because deciding on the present two
issues did not cause more workload for the EPO</span>. </blockquote>
Evidemment, l'Office apprécie à sa juste mesure que l'on juge de la pertinence ou non de payer les taxes... Mais tout de même, au détour du motif 2, on trouve cette phrase curieuse : <i>La Chambre relève que la structure des taxes de la CBE ne reflète pas nécessairement la charge de travail effectivement imposée à l'OEB dans chaque situation individuelle.</i><br />

2. Refund of one fee for re-establishment of rights</blockquote>
<blockquote class="tr_bq">
[...]The board takes this
as an indication that <span style="background-color: #f4cccc;">each time limit has to be considered separately</span>
and concludes that, in the absence of any hint to the contrary, for the
number of fees to be paid the number of missed time limits is decisive.</blockquote>

The same reasoning applies
to the requests for re-establishment of rights in relation to the
filing of a notice of appeal and of the grounds of appeal, firstly
because the corresponding time limits expire independently of one
another, notwithstanding the fact that they are triggered by the same
event, namely the dispatch of the written reasons for a decision. The
board notes that for example if the time limit for filing an appeal were
extended from a weekend to a Monday by virtue of Rule 134(1) EPC, this
would have no effect on the expiry of the time limit for filing the
grounds of appeal. Secondly, failure to meet either of these time limits
individually results in a loss of the right to appeal. Article 108 EPC,
first sentence, states that the appeal shall be filed within two months
of the notification of the decision and Article 108 EPC, third
sentence, provides that a statement setting out the grounds of appeal
shall be filed within four months of notification. Failure to comply
with either one of the two time limits would cause the appeal to be
rejected as inadmissible, provided that the appeal fee was paid.
Consequently, <span style="background-color: #f4cccc;">two fees for re-establishment were indeed due and hence a
refund of one of those fees is not possible</span>.</blockquote>
<blockquote class="tr_bq">
The applicant's
counter-arguments were not convincing. It depended on the principle of
good faith combined with the fact that it put no additional workload on
the EPO to decide on these two omitted acts rather than only one to
justify its opinion that only one fee was payable. In this respect <span style="background-color: #f4cccc;">the
board notes that the fee structure of the EPC does not necessarily
reflect the actual workload imposed on the EPO in any individual case</span>.
Rather, legislators have chosen lump sums as fees that are for example
independent of the number of auxiliary requests to be decided or the
days allowed for conducting oral proceedings.</blockquote>

Dans la décision intermédiaire <a href="http://www.epo.org/law-practice/case-law-appeals/recent/t131553dx1.html#q=">T 1553/13</a>, la Chambre de Recours a adressé la question suivante à la Grande Chambre :<br />

Soit (traduction libre), "Un recours est-il irrecevable, ou bien réputé non formé, lorsque le dépôt de l'appel et le paiement de la taxe de recours sont effectués après l'expiration du délai de recours mentionné article 108 phrase 1 CBE ?".<br />

La question peut paraître curieuse à la lecture de l'art.108 phrase 2 CBE : "Le recours n'est réputé formé qu'après le paiement de la taxe de recours". Évidemment, la Chambre est aussi au courant.<br />
<br />
Revenons rapidement à la base de la décision. La décision de la Division d'Opposition, datée du 25.04.2013, parvient à l'Office du mandataire le 26.04.2013 (un mardi) où elle est réceptionnée par un certain "Weber". Le mandataire signe l'accusé de réception le 07.05.2013 et forme un recours deux mois plus tard, le 08.07.2013 (un lundi).<br />
<br />
Pour l'OEB, le recours devait être formé au plus tard le 05.07.2013 (vendredi), soit la date déterminée en ajoutant la fiction des 10 jours de la R.126(2) CBE plus le délai de deux mois de l'art.108 CBE 1ère phrase.<br />
<br />
Le mandataire tente bien de se défendre en invoquant le code des postes Allemand pour justifier que le point de départ du délai de 2 mois était la date de signature (le 07.04.2013), lequel se situait au delà du délai fictif de 10 jours. La Chambre évacue rapidement la question. Le recours n'est pas valable.<br />
<blockquote class="tr_bq">
4. Die Auffassung des Vertreters der Beschwerdeführerin, dass die
zweimonatige Beschwerdefrist ausgehend vom Datum der Unterzeichnung des
Empfangsbekenntnisses am 7. Mai 2013, das dem Tag der tatsächlichen
Kenntnisnahme entspreche, zu berechnen sei und folglich die
Beschwerdeschrift rechtzeitig eingegangen wäre, <span style="background-color: #f4cccc;">entspricht nicht der Rechtslage</span>. </blockquote>
Oui mais... Est-ce que le recours est "réputé non formé", ou bien "irrecevable" ? De la sanction juridique va découler le remboursement, ou non, de la taxe de recours !<br />
<br />
Le cœur du problème provient de la formulation de l'art.108 CBE 2ème phrase, et de son articulation avec la R.101(1) CBE, soit d'une part "Le recours <u>n'est réputé formé qu'après</u> le paiement de la taxe de recours", et d'autre part "Si le recours n'est pas conforme aux articles 106 à 108 [...], la chambre de recours le <u>rejette comme irrecevable</u>, à moins qu'il n'ait été remédié aux irrégularités <u>avant l'expiration du délai</u> applicable en vertu de l'article 108".<br />
<br />
Donc d'un coté, tant que la taxe n'est pas payée, le recours n'est pas réputé formé, mais si on remédie à l'irrégularité après le délai, le recours est irrecevable. Un recours peut-il être irrecevable s'il est non formé ?<br />
<br />
La Chambre relève tout d'abord que, dans la majorité des décisions, un paiement tardif a aboutit à considérer le recours <u>réputé non formé</u>, et par conséquent au remboursement d'office de la taxe de recours (car le paiement a été réalisé sans cause). Elle cite, par exemple, la décision <a href="http://www.epo.org/law-practice/case-law-appeals/recent/j820016fp1.html#q=">J 16/82</a>:<br />

2. L'une des conditions de la recevabilité d'un recours est le
paiement de la taxe correspondante dans un délai de deux mois,

1981, JO de l'OEB n° 4/1981, p. 101 déjà mentionnée au point 2).

10. Lorsqu'en application de l'article 108, deuxième phrase de la CBE,
un recours est considéré comme non formé au motif que la taxe
correspondante n'a été payée qu'après l'expiration du délai prescrit
pour l'introduction du recours,<span style="color: #990000;"> </span><span style="background-color: #f4cccc;">un tel paiement perd sa raison d'être. Il y a donc lieu d'en rembourser d'office le montant</span>.</blockquote>
Sauf que... Un certain nombre de décisions divergentes ont conclu à l'<u>irrecevabilité </u>du recours, et par conséquent au non remboursement de la taxe.<br />
<blockquote class="tr_bq">
8.1.2 In den Entscheidungen T 1289/10, T 1535/10 und T 2210/10 wurde
Beschwerde als unzulässig verworfen <span style="background-color: #f4cccc;">ohne dass eine Rückzahlung der Beschwerdegebühr angeordnet worden ist</span>, obwohl die Beschwerde nach
Ablauf der Beschwerdefrist eingelegt wurde und obwohl die
Beschwerdegebühr erst nach Ablauf dieser Frist gezahlt wurde. In den
Gründen wurde dies nicht behandelt.</blockquote>

seem to support this interpretation. In the "Materialien zum EPÜ"
(IV/6514/61-D) is provided for, with reference to the
"Entscheidungsmöglichkeiten der Beschwerdekammer" , that "Die Kammer
kann feststellen, dass die Beschwerde wegen Nichtentrichtung der Gebühr
unzulässig ist"</blockquote>
Par conséquent, il est nécessaire de trancher clairement la conséquence juridique, afin de savoir s'il faut rendre les sous ou pas (ce qui rappelle cette vielle citation : "nous rendons la justice, mais nous ne rendons pas l'argent")<br />

In der hier zu entscheidenden Sache hängt es von der Auslegung des

est présente régulièrement dans la CBE. La Chambre, au point 8.2 des motifs, fait une
liste assez conséquente. En revanche, autant les conséquences, par exemple, d'un paiement tardif de la taxe d'examen sont très claires (art.94(1) ens. R.70(1) CBE : on paie dans un délai de 6 mois. Une requête formée hors délais a pour conséquence que la demande est réputée retirée art.94(2) CBE, les modalités de remboursement étant déterminées dans le Règlement Relatif aux Taxes), autant un tel mécanisme semble manquer pour l'art.108 CBE ce qui, dans la langue de l'inspecteur Derrick, s'expose:<br />

Hinzu kommt, dass die Vertragsschließenden des Europäischen
Patentübereinkommens an anderer Stelle sehr wohl Formulierungen
verwenden, die Konsequenzen nicht rechtzeitiger Verfahrenshandlungen

ausdrücklich, wann und in welchem Umfang die Prüfungsgebühr
zurückgezahlt wird. Regelungen dieser Art fehlen zu Artikel 108 Satz 2
EPÜ. <span style="background-color: #f4cccc;">Es erscheint deshalb als nicht systemgemäß in Artikel 108 Satz 2 EPÜ ein Wort hineinzulesen, das dort nicht steht</span> (siehe oben 8.4.2, 1.

En revanche, les questions étaient moins immédiates que les années précédentes.</div>

Le 4 janvier, dernier jour du délai donc, l'opposant a indiqué que des témoins allaient intervenir. Le 22 février, la Division d'Opposition a annulé la procédure orale, indiquant principalement qu'elle invitait l'opposant à fournir les noms et adresses des témoins (ils ont été fournis le 20 avril 2010).</div>

Le breveté avait demandé une répartition différente des frais, justifiée par le report de la procédure orale qui n'était pas de son fait. Il a été débouté de sa demande par la Division d'Opposition au motif que (traduction libre) "Même si les témoins avaient été nommés dans la lettre du 04.01.2010, la Division d'Opposition aurait repoussé la procédure orale, car un délai d'au moins deux mois doit être observé entre la citation des témoins et la procédure orale (R.118(2) CBE)".</div>

proceedings, namely only two months before the date of the scheduled
oral proceedings, without cogent reasons for the delay <u>and in particular
without submitting all necessary information</u></span>, i.e. the name(s) and
address(es) of the witness(es) in question. The latter was only done
after a further delay of one month.</span></div>

earlier stage of the opposition proceedings or, at least, directly after
receiving the opposition division's summons and communication. The
latter was clear on the issue of the relevance of that prior use for
novelty and inventive step.<span style="color: orange;"></span></span></div>

<span style="font-family: "Courier New",Courier,monospace;"><span style="color: orange;">If it had submitted this material at such a point in time that the two
months time limit of Rule 118(2) EPC could have been complied with in
respect of the date originally set for the oral proceedings, no
postponement would have been necessary and the appellant's costs would
not have been incurred unnecessarily.</span></span></div>

to the submission of the "second" portion with the names and addresses
of the witnesses as late as on 20 April 2010.</span></div>

The respondent's argument that it was faced with difficulties in
locating the two witnesses, who had changed employment, cannot hold as<span style="color: orange;">
it had sufficient time between the filing of the opposition and mention
of the prior use in July 2006 and the issuance of the summons to oral
proceedings in September 2009 to find both persons</span> who were active at
that time for Topack GmbH, a company within the same conglomerate as the
opponent, up to the end of 2003. Further, it does not take away the
procedural fact that the responsibility for stating its complete case,
including all necessary evidence, and the risk for any failure in doing
so lie exclusively within the respondents own sphere. As a consequence,
any delay causing the incurring of additional costs by the other party
remains within the respondent's sphere and liability.</span></div>

L'unique soucis du breveté (du moins d'après ce que l'on peut lire dans la décision), et la motivation de son silence sont une économie de procédure. La Chambre n'est pas convaincue, et utilise de nouveau le <b>gras</b> : </div>

<span style="font-family: "Courier New",Courier,monospace;">1.4 The respondent argues that it has<b> deliberately waited</b> for the
preliminary opinion of the Board before reacting <span style="color: orange;">as, otherwise, it would
have had to file with its reply to the statements of grounds of
appeals, as a precautionary measure, an extremely high number of new
requests in view of the numerous new issues raised. This would have led
to presenting the Board with an undue, possibly useless, burden.</span> The

Board's preliminary opinion before filing any reaction, exactly for
reasons of procedural economy, because the requests would then be more

Il convient donc d'analyser si le mémoire du recours est correctement motivé (art.108 CBE et R.99(2) CBE) et si les documents nouvellement produits n'auraient pas pu l'être en première instance.</div>

7. Documents (D11) to (D15) were not part of the first instance
opposition proceedings but were filed by the appellant-opponent with its

evidence instead of providing reasons why the conclusions of the
opposition division as regards Article 100(a) EPC (novelty and inventive
step) vis-à-vis the documents on file in the first instance proceedings

and this principle is reflected in Article 12(4) RPBA. <span style="color: orange;">The appeal
proceedings are not about bringing an entirely fresh case</span> [...].

Therefore the claims of auxiliary request 2 relate to subject-matter for
which the appellant-opponent could have been expected to substantiate

(D11) to (D15) cannot be regarded as being justified by the amendments
made by the appellant-patentee before the opposition division.

15. If the appellant-opponent was surprised by the decision of the
opposition division, such surprise may be an understandable subjective
reaction but such subjective surprise cannot change the fact that the
line of reasoning relied on by the opposition division was in the
proceedings and was known to the appellant-opponent. <span style="color: orange;">Indeed, if the
decision under appeal had been based on a line of reasoning unknown to
the appellant-opponent, it should have argued that its right to be heard
had been violated - which it did not. </span>Moreover, the appellant-opponent
did not state that it was surprised by the decision of the opposition
division when it filed its grounds of appeal, but only when the
admissibility of the documents was challenged by the appellant-patentee.

the issue that a claim relating to a pharmaceutical composition
comprising an antibody that per se was considered not to be inventive,
could be considered inventive, </span><span style="color: orange; font-family: "Courier New",Courier,monospace;">but bring about a </span><b style="color: orange; font-family: "Courier New",Courier,monospace;">fresh case</b><span style="color: orange; font-family: "Courier New",Courier,monospace;">, tantamount
to a new opposition by attacking subject-matter which was present in the
claims as granted</span><span style="font-family: "Courier New",Courier,monospace;"> on the basis of new evidence under Article 54 EPC and
56 EPC. [...]</span>

Après analyse, aucun des documents (D11) à (D15) n'est considéré comme étant <i>prima facie</i> très pertinent, ce qui prive le mémoire de recours de sa base factuelle et évidente (ouh, le vilain anglicisme...)<br />

provisions of Rule 99(2) EPC.
